TERMS OF BUSINESS

TERMS & CONDITIONS

The Seller agrees to appoint One2One Estate Agents Ltd as their agent on the following terms:

TYPE OF AGENCY, FEES AND PAYMENT

SOLE AGENCY

One2One Estate Agents is appointed as sole agent. The contract has no tie in period therefore this sole agency will continue until terminated by written notice by either the seller or the agent.
The fee for this sole agency is **** This fee of **** will only be payable on the sale of your property. We provide a “no sale no fee” service.

PART EXCHANGE
If we sell your property by way of a part or full exchange for another property, then the **** sale fee will be payable.

TERMINATION OF OUR AGENCY
Our agency may be terminated by either party giving notice at any time. There is no tie in on the agency so termination can be made at any time. However, if a purchaser introduced by us exchanges unconditional contracts on the property within 6 calendar months of the termination of our agency then the vendor will be liable to pay our ****  sale fee.

PAYMENT OF ACCOUNTS
The fee of **** is to be paid on completion and you are signing to authorise your solicitor to pay One2One Estate Agents Ltd out of the sale of the property proceeds and this payment is to be paid promptly.

UNOCCUPIED PROPERTY
We are not responsible for the maintenance or repair of any vacant property unless this is agreed in writing. It is therefore your responsibility to ensure that all main services are turned off, water and heating systems professionally drained and the insurers of the property notified.

FOR SALE BOARD
Unless otherwise stated you authorise us to erect a for sale board

RELATED SERVICES
It is our intention to offer our full range of sales, mortgage and related services to all suitable applicants.

QUALIFYING OF VIEWER/POTENTIAL PURCHASER
Unless agreed in writing by yourself (The Vendor) we will qualify every viewer & potential purchaser to ensure they are in a potentially proceedable position.

PROPERTY MISDESCRIPTIONS ACT 1991 (“PMA”) 
The PMA prohibits the making of any false or misleading statements, written, verbal or photographic about the property. We will ask you to confirm that everything in the sales particulars are correct. We may ask you to verify any particular point about the property, in which case you must assist us to the best of your knowledge. You must also tell us if you become aware at any time of any inaccuracy in our sales particulars, advertising copy, press releases or any other information which we produce relating to the property. You must also instruct your solicitors to answer any points we may raise with them about the property or its legal title.

CO-OWNERSHIP

In the event the property is held in co-ownership, you hereby confirm that any co-owners have given you authority to sign these terms on their behalf.

DISCLOSABLE INTERESTS
We have to disclose any interest we might have with the property (buying or selling). This would include an interest by a connected party such as our staff and members of their family. To help us to do this, we ask that you tell us if you are in any way related to a Partner or member of staff, or if you are a business associate of any of them.

THE PROPERTY REDRESS SCHEME
As well as our own internal complaints procedures, we are also members of the Property Redress Scheme. Copies of both are available on request.

UNFAIR CONSUMER TERMS REGULATIONS (1999)
We are required to ensure that these standard terms are fully understood and acceptable. If you do not wish to accept, or do not understand, any of these terms please tell us and will do our best to accommodate any reasonable amendment. By signing our Terms of Business it is assumed that you accept the agreed terms and the fact that they are reasonable

CANCELLATION OF CONTRACT
Regulations allow for a client to cancel a contract within 14 days of its signing. Unless advised to the contrary One2One Estate Agents Ltd assume authorisation for the performance of the contract to be commenced immediately.

PROFESSIONAL PHOTOGRAPHER
One2One Estate Agents employ a professional photographer Sean Scrivens of “Scrivlens Photography” for all of our property photos. Should you decide to not instruct us to market your property after photographs have been taken you will be liable for the photographers £50.00 fee.
